What is the individual complaints procedure?

The individual complaints procedure is a monitoring procedure used by UN organs for the implementation of human rights. It allows the individual to bring a complaint of violations of his/her rights by a particular state before an independent UN-Committee - but only after all domestic legal remedies have been exhausted.

So far there are five conventions in international law which contain the right of individual complaint: the International Covenant on Civil and Political Rights, the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, the International Convention on the Elimination of All Forms of Racial Discrimination, the International Convention on the Protection of Rights of All Migrant Workers and Members of their Families, the Convention on the Elimination of All Forms of Discrimination against Women. Kindernothilfe is committed to achieving the introduction of an individual complaints procedure to the Convention on the Rights of the Child of 1989.
